These Terms of Use govern access to pasby.africa, the pasby mobile application, APIs, and related services (collectively, the “Services”) operated by Finsel DGI Limited (“Finsel DGI”, “we”, “us”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

pasby provides digital identity, authentication, authorization, verification, and signature infrastructure for individuals and institutions. Consumer features are provided through the pasby app; institutional features through separate agreements, consoles, and APIs.

2. Eligibility

  • You must be at least 13 years of age to activate a personal pasby eID, or the minimum age required in your jurisdiction if higher.
  • You must provide accurate information during activation and keep your credentials confidential.
  • Institutional use requires valid credentials and compliance with your organisation’s policies and applicable law.

3. Your account & credentials

  • You are responsible for activity under your pasby credentials and device.
  • Notify us promptly if you suspect unauthorised access.
  • We may suspend or revoke access where we detect fraud, abuse, or security risk.

5. Acceptable use

  • Do not use pasby for unlawful activity, impersonation, or circumvention of security controls.
  • Do not attempt to reverse engineer, scrape, or overload the Services except as permitted by law or written agreement.
  • Do not misuse institutional credentials or APIs outside authorised scope.

6. Intellectual property

pasby, its logos, documentation, and underlying technology are owned by Finsel DGI or its licensors. These Terms do not grant ownership — only a limited right to use the Services as intended.

7. Availability & changes

We strive for high availability but do not guarantee uninterrupted access. Maintenance, upgrades, or events beyond our control may affect the Services.

We may modify features or these Terms. Continued use after posted changes constitutes acceptance.

8. Disclaimers

The Services are provided “as is” to the extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement except where exclusion is prohibited.

9. Limitation of liability

To the maximum extent permitted by law, Finsel DGI is not liable for indirect, incidental, special, or consequential damages arising from use of the Services. Our aggregate liability for direct damages is limited to the greater of amounts paid by you to us in the twelve months preceding the claim or one hundred US dollars, except where limitation is prohibited.

10. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of courts in Nigeria unless mandatory local law provides otherwise.
